When you lose a loved one, it is hard to imagine being able to move forward with your life. You don’t want to think what it will be like to face a life without him or her. The situation is even worse when you rely on your loved one’s income to pay the household bills. If the death was the result of a work accident, you may be able to recover compensation.
The New York workers’ compensation law gives surviving dependents the ability to obtain financial benefits. This law provides that if the New York worker dies because of a compensable injury, meaning one that is covered by workers’ compensation insurance, then the dependents may qualify for weekly benefits. These benefits are equivalent to two-thirds of the worker’s average weekly income for the year prior to the deadly on-the-job-accident.
Based on the workers’ comp law, dependents include the spouse, minor children or other family member. It is important to note that the benefits paid will not be in excess of the weekly maximum allowed by the law, even if there are numerous dependents.
